When considering compliance for Electronics, Computers and Telecommunications these are all items that have their own category within the Dual Use regulations. This means that if the goods to be exported match the criteria of the technical capability listed within the UK Strategic Export Control list a licence must be declared to HMRC to allow the export to take place. Dual Use Technology (technical information relating to the goods) and Software are also controlled as licensable from the UK even if the transfer is intangible.


The relevant categories for these items are “3” Electronics, “4” Computers and “5” Telecommunications and Information Security. The 8 Digit Export Commodity Code can signpost us towards the fact that Dual Use controls could apply but a technical assessment of the goods against the Control List criteria is the only sure way to establish if a licence is needed.     


The End Use destination and the reason why the goods are being exported can have a bearing on the type of licence that must be obtained. Open Licences are available for certain countries where the Export Control Joint Unit are content to provide this type of approval. Use of this type of licence will result in an audit for the exporter to demonstrate compliance against the UK Export Control regulations. In other instances, the exporter will need to apply for a licence via the electronic SPIRE portal to seek approval for the goods to be sent from the UK.  

Under US Extra-territoriality controls we must also consider a US Licence in addition to the UK regulations. The EAR (Export Administration Regulations) mirrors the items are controlled in the UK as Dual Use but also controls additional items which were added under the 2013 US Export Control Reform.             



Separate to Export Controls are the regulations and requirements surrounding Waste Electrical and Electronic Equipment recycling. Commonly known as the WEEE regulations, producers (defined in the regulations) have the responsibility to comply with the rules on goods controlled under EEE criteria that are sold as well as products that become waste.

On-line training courses and e-learning

Although we have a number of on-line international trade training courses for sale publically on our website our main area of on-line training is creating bespoke in-company training solutions which enables businesses to create their own e-learning training packages in bite-sized chunks – what we call SPOTLIGHTS – lasting between 1-2 hours per session. These SPOTLIGHTS can cover standard topics (as listed above) but the main advantage of this type of training solution is that we can ensure SPOTLIGHTS are written (and kept up-to-date) specifically covering what your business needs.

Therefore, we are able to offer Distance Learning courses for all areas of international trade and customs compliance, some topics already exists other may have to be developed to make them in-company specific. Distance Learning can be via our on-line training portal which can be used on an individual basis (cost of between £35.00 – £65.00 per person/ per session) or as a corporate designed package administered either by S&H or by you. Alternatively we can organise bespoke interactive webinars, generally up to 2 hour long, to cover bite-sized chunks of information. This can be supported, if required, by the use of our assessment programmes.
